Does ERISA apply to fully-insured health plans?

Yes. ERISA covers virtually all employer-sponsored group health plans, whether fully-insured or self-funded. Fully-insured employers still have fiduciary duties — selecting the carrier prudently, monitoring fees and service, distributing required documents, and handling employee contributions properly.

A common misconception is that buying insurance outsources ERISA. It doesn't. A fully-insured group health plan is still an ERISA plan, and the employer is still a fiduciary for the functions it performs.

For fully-insured plans that means, at minimum:

  • Prudently selecting and monitoring the insurance carrier and broker, including compensation
  • Handling employee premium contributions as plan assets — forwarding them promptly
  • Maintaining and distributing the plan document, SPD, and required notices
  • Complying with reporting obligations such as Form 5500 where applicable

Self-funding raises the stakes — claims fiduciary exposure, stop-loss decisions, and more data obligations — but the fully-insured employer that ignores governance entirely is taking on more risk than it realizes.
